By accessing or using our website or services, you agree to these Terms. If you do not agree, do not use our website or services.

1. Acceptance and Changes to These Terms

By using our website, creating an account, purchasing a product, enrolling in a course, or accessing membership materials, you agree to be legally bound by these Terms and any additional terms presented during a purchase or enrollment process.

You should review these Terms periodically. We may also update, modify, suspend, or discontinue any portion of the website, membership area, course, product, or service at any time.

2. Eligibility

You must be at least 13 years old to use our website or services.

If you are under 18, you may use our website or services only with the involvement, supervision, and consent of a parent or legal guardian. 5. Intellectual Property and Copyright

Our website and services, including text, articles, courses, lessons, videos, audio, graphics, photographs, logos, trademarks, software, downloads, worksheets, recordings, and other materials, are owned by Schuneman Enterprises or licensed to us by third parties. These materials are protected by copyright, trademark, and other intellectual-property laws.

Subject to your compliance with these Terms, we grant you a limited, personal, nonexclusive, nontransferable, and revocable license to access and use the website and materials for your own permitted educational or business purposes.

Unless we give you written permission, you may not:

Any unauthorized use automatically terminates the permission granted under this section. Upon termination, you must stop using the applicable materials and delete copies in your possession, except where retention is required by law.

All rights not expressly granted in these Terms are reserved.

6. Trademarks and Third-Party Names

“Schuneman Enterprises,” our logos, and other marks associated with our business are our trademarks or service marks, or are used with permission.

Third-party company names, product names, logos, and trademarks belong to their respective owners. Mentioning or linking to a third party does not necessarily mean that the third party endorses, sponsors, or is affiliated with Schuneman Enterprises.

7. Affiliate Disclosure and Earnings Disclaimer

We may recommend, review, advertise, or link to products and services offered by third parties. We may receive commissions, referral fees, compensation, free products, discounts, or other benefits when you click a link, sign up for a service, or make a purchase.
We may be compensated for certain purchases or actions connected with our website, emails, advertisements, or other promotional content. Additional disclosures may appear near particular links or recommendations.

Our content is educational and informational. We do not guarantee that you will earn money, increase sales, grow a business, or achieve any particular result by using our content or purchasing a product or service.

Your results depend on many factors, including your experience, skills, effort, resources, market conditions, business model, timing, and circumstances beyond our control. Any examples, income figures, case studies, or testimonials represent the results of particular individuals or businesses and are not guarantees or promises of typical or expected results.

You should conduct your own research and make purchasing and business decisions based on your own circumstances.

8. Educational and Professional Disclaimer

Our content is not legal, medical, tax, accounting, investment, financial, or other professional advice. Use of our website or services does not create an attorney-client, physician-patient, accountant-client, investment-advisor, or other professional relationship.

You should consult an appropriately qualified professional before making decisions involving legal, financial, tax, medical, or other professional matters.

9. Third-Party Products, Services, and Links

Our website may contain links to third-party websites, products, software, platforms, courses, services, or resources.

We do not control third-party websites or guarantee the accuracy, availability, security, quality, or performance of third-party products or services. We are not responsible for third-party terms, privacy policies, content, practices, transactions, customer service, or results.

If you purchase or use a third-party product or service, your relationship is with that third party. You should review the third party’s terms and privacy policy before proceeding.

Unless we expressly state otherwise, we do not provide customer support, refunds, technical assistance, or fulfillment for third-party products or services. You should contact the third-party provider directly.

10. Acceptable Use and Prohibited Conduct

11. Privacy

Our Privacy Policy explains how we collect, use, and protect personal information. The Privacy Policy is incorporated into these Terms.

You can review the Privacy Policy on our website or contact us with privacy-related questions or requests at:

12. Website Availability and Security

We do not guarantee that the website, membership area, courses, downloads, or other services will always be available, uninterrupted, secure, or error-free.

Access may be interrupted or unavailable because of maintenance, updates, technical problems, internet failures, platform outages, security incidents, or circumstances beyond our control.

You are responsible for maintaining appropriate equipment, internet access, security software, and backups for your own devices and data.

13. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE, CONTENT, PRODUCTS, SERVICES, MEMBERSHIP AREA, COURSES, DOWNLOADS, AND RELATED MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND SUITABILITY.

WE DO NOT WARRANT THAT THE CONTENT WILL BE COMPLETE, CURRENT, RELIABLE, ERROR-FREE, OR SUITABLE FOR YOUR PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE WEBSITE OR ANY DOWNLOADABLE MATERIAL WILL BE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

Nothing in these Terms excludes a warranty or right that cannot legally be excluded.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SCHUNEMAN ENTERPRISES, LLC, AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

This limitation includes damages arising from or related to loss of profits, revenue, business opportunities, data, goodwill, use, or other intangible losses, even if we were advised that such damages were possible.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the website, services, products, or these Terms will not exceed the greater of:

  • The amount you paid to us for the particular product or service giving rise to the claim during the twelve months before the event giving rise to the claim; or
  • One hundred dollars ($100).

These limitations apply regardless of the legal theory of liability, including contract, warranty, negligence, tort, strict liability, or any other theory.

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, liability will be limited to the maximum extent permitted by law.

15. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Schuneman Enterprises, LLC, and its owners, members, officers, employees, contractors, agents, licensors, and service providers from and against claims, demands, losses, liabilities, damages, judgments, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • Your use or misuse of the website, products, or services;
  • Your violation of these Terms;
  • Your violation of another person’s rights;
  • Your violation of applicable laws or regulations; or
  • Your account or conduct on the website.

We reserve the right to assume exclusive control of the defense of any matter subject to indemnification. You agree to cooperate with our defense of such claims.

16. Suspension and Termination

We may suspend, restrict, or terminate your access to the website, account, membership area, courses, or services at any time if we believe you have violated these Terms, misused our materials, failed to make a required payment, compromised account security, or created risk for us or another person.

We may also discontinue any product, service, course, membership, or portion of the website at any time.

Upon termination, your right to access and use restricted materials ends immediately. Provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution, and any other provisions that by their nature should survive termination will continue to apply.

17. Governing Law

These Terms and any dispute arising out of or relating to these Terms or your use of the website or services will be governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

The Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions below to the extent applicable.

18. Informal Dispute Resolution

Before initiating arbitration, you agree to contact us at the following email and provide a written description of the dispute and the relief you are seeking.

We will have 30 days to attempt to resolve the dispute informally. This informal process is a condition precedent to filing an arbitration claim, unless applicable law provides otherwise.

19. Mandatory Binding Arbitration

To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms, the website, products, services, membership access, or any transaction between you and Schuneman Enterprises will be resolved through final and binding arbitration rather than in court.

The arbitration will be administered by the American Arbitration Association (“AAA”) under its applicable Consumer Arbitration Rules, unless the parties agree otherwise or applicable law requires a different procedure.

The arbitration will be conducted by one neutral arbitrator. Unless the parties agree to another format, the arbitration will take place remotely or in the State of Colorado. The arbitrator will have authority to award the same individual remedies that a court could award under applicable law, but may not award relief that would affect persons who are not parties to the arbitration.

The arbitrator’s decision will be final and binding, and judgment on the award may be entered in any court with jurisdiction.

The parties will each bear their own attorneys’ fees and costs unless applicable law or the arbitrator’s decision allows otherwise. Administrative, filing, and arbitrator fees will be allocated according to the applicable AAA rules and applicable law.

Nothing in this section prevents either party from seeking temporary, preliminary, or injunctive relief in a court of competent jurisdiction when necessary to protect intellectual-property rights, confidential information, account security, or prevent unauthorized access or use.

20. Class Action and Representative Action Waiver

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND SCHUNEMAN ENTERPRISES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, REPRESENTATIVE, OR PARTICIPANT IN ANY CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE-ATTORNEY-GENERAL, OR REPRESENTATIVE ACTION.

The arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that individual party’s claim. Claims may not be combined with or arbitrated together with claims brought by another person unless all affected parties agree in writing.

If a court determines that this class-action waiver is unenforceable for a particular claim, that claim will proceed in court and not in arbitration, and any remaining claims will continue to be arbitrated to the fullest extent permitted by law.

21. Time Limit for Claims

To the fullest extent permitted by law, any claim or cause of action arising out of or relating to the website, services, products, or these Terms must be commenced within one year after the claim arose. Otherwise, the claim is permanently barred.

This limitation does not apply where a longer period is required by applicable law.

22. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be modified or limited to the minimum extent necessary to make it enforceable. If it cannot be made enforceable, it will be severed from these Terms.

The remaining provisions will remain in full force and effect.

23. Entire Agreement

These Terms, together with any applicable purchase terms, product-specific terms, Privacy Policy, Copyright Notice, Disclaimer and FTC Disclosure, and other policies posted on our website, constitute the entire agreement between you and Schuneman Enterprises concerning your use of the website and services.

These Terms replace all prior or contemporaneous agreements, representations, and understandings concerning the same subject matter.

24. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later. A waiver must be in writing and signed by an authorized representative of Schuneman Enterprises.

25. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer these Terms or our rights and obligations to an affiliate, successor, purchaser, or other entity in connection with a merger, sale, reorganization, or transfer of our business or assets.
